On Wednesday, November 4, 2021 Attorney General Wayne Stenehjem issued an opinion on the validity of SB 2030.

SB 2030 prevents the state university institutions from partnering with abortion providers. The State Board of Higher Education and the North Dakota University System (NDUS) sought to avoid complying with SB 2030 and asked the Attorney General for an opinion its constitutionality. In fact, the NDUS provided a lengthy letter arguing that the law was unconstitutional.

The Attorney General rejected all those claims.

The North Dakota Catholic Conference applauds the Attorney General's opinion. SB 2030 was a legitimate exercise of the state legislature to ensure that the state of North Dakota does not partner with abortion providers. North Dakota is a pro-life state and SB 2030 reflected that fact.
